Welcome to Virtual Home Photography. By accessing or using our services, you agree to comply with and be bound by the following Terms of Service. Please read them carefully.

1. Services Provided

Virtual Home Photography provides virtual tours, real estate photography, and related services. By booking or using our services, you agree to abide by these Terms.

2. Eligibility

You must be at least 18 years old or have the legal capacity to enter into a binding agreement in your jurisdiction to use our services.

3. Booking and Payments

Payment terms will be communicated at the time of booking and/or stated on the invoice. By booking a service, the client agrees to pay all applicable fees in full within the stated payment period. Unless otherwise agreed in writing, all invoices are due upon receipt.

Virtual Home Photography reserves the right to withhold delivery of services, suspend ongoing work, or disable access to any deliverables until payment has been received in full. Failure to make payment may result in the cancellation of current or future bookings.

3A. Late Payments, Non-Payment, and Collections

Invoices that are not paid by the stated due date will be considered past due. Virtual Home Photography may send payment reminders and notices via email, SMS, phone call, or WhatsApp at reasonable intervals until payment is received.

If an invoice remains unpaid for thirty (30) days from the invoice date, the account will be considered delinquent. Virtual Home Photography reserves the right to charge a late payment fee of ten percent (10%) per month, or the maximum rate permitted by law (whichever is lower), on any outstanding balance. Late fees will be calculated monthly and compounded until the balance is paid in full.

If, after thirty (30) days, it is reasonably determined that the client is avoiding payment, making repeated payment excuses, or otherwise demonstrating an intent not to pay, Virtual Home Photography may, without further notice, take appropriate action. This may include referring the outstanding balance to a third-party collection agency, notifying the client’s Broker of Record, escalating the matter to the Real Estate Council of Ontario (RECO) where applicable, and/or pursuing recovery through Small Claims Court or other legal remedies.

The client agrees to be responsible for all reasonable collection costs incurred, including but not limited to collection agency fees, legal fees, court costs, and administrative expenses, to the extent permitted by law. Non-payment may result in permanent termination of services and refusal of future work.

4. Use of Deliverables

• All photographs, virtual tours, and other deliverables are provided for personal or business use related to real estate marketing unless otherwise agreed in writing.

• You may not resell, sublicense, or redistribute our deliverables without prior written consent.

5. User Responsibilities

By using our services, you agree:

• To provide accurate information when booking.

• To obtain any necessary permissions for photographing a property.

• Not to use our services for unlawful or unauthorized purposes.

6. Intellectual Property

All content created by Virtual Home Photography, including photos, virtual tours, and related materials, remains our intellectual property unless otherwise agreed in writing. You are granted a limited, non-transferable license to use the content for its intended purpose.

7. Limitation of Liability

While we strive to deliver high-quality services, Virtual Home Photography is not liable for:

• Any damages arising from delays, technical issues, or service interruptions.

• Losses caused by misuse of deliverables by clients or third parties.
  Our total liability is limited to the amount paid for the specific service in question.

8. Privacy

Our collection and use of personal information are governed by our [Privacy Policy]. By using our services, you consent to the practices described therein.

9. Changes to These Terms

We may update these Terms of Service from time to time. Changes will be posted on our website, and continued use of our services constitutes acceptance of the revised Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
